MARPOL 73/76(1997) Annex VI Reg. 14 & 18.


    1. Reg. 14(1) : The sulphur content of any fuel used on board ships
                    shall not exceed 4.5%m/m. This is applied globally so
                    there is no fuel on board ship with sulphur content
                    above this level anywhere.  Takes effect on May 19,
                    2005.

    2. Reg. 18(3) : requires that the Bunker Delivery Note(BDN) shall
                    contain at least the  following details providing specific
 details of bunkers supplied ( outlined in Appendix V of
 Regulation 18 Annex VI) :

                -. Name and IMO No. of receiving ship
                -. Port of Delivery
                -. Date of commencement of delivery
                -. Product name(s)
                -. Quantity
                -. Density at 15 Deg. C. *
                -. Sulphur content (%m/m ) **
                -. A declaration signed and certified by the fuel oil
supplier's representative that the fuel oil supplied is in
conformity with regulation 14(1) or (4) (a) and regulation
18(1) of this Annex.
                *  Fuel oil should be tested in accordance with ISO 3675.
                **  Fuel oil should be tested in accordance with ISO 8754.

   

3. Reg. 18(4)  : The BDN shall be kept on board for a period of three
years after the fuel is delivered and must be readily
available for inspection.
 
 4. Reg. 18(6)  : requires that the BDN shall be accompanied by a
representative sample of the fuel oil delivered. The sample
is to be solely for determination to Annex VI of MARPOL
73/78. It must be clearly understand by both supplier and
receiving vessel that this statutory sample shall be in
addition to any other commercial sample that is obtained
and must not be used for resolution of a commercial
dispute or for any other verification purpose other than
that for Annex VI. Therefore a statutory sample should be
clearly labelled " For ANNEX VI ".

    The BDN shall be accompanied by a representative sample of fuel oil
 delivered, taking into account MPEC 96.(47) guidelines:

        -. sampling position to be at the receiving vessel's bunker manifold
        -. sampling method should be by continuous drip or auto sampler
drawn continuously over the bunkering period
        -. sample shall be not less than 400 ml
        -. the supplier's representative is to seal the sample in the
 presence of the ship's representative with a unique seal
        -. sample label must include 1) location( ship's bunker manifold) at
 which bunkering has taken place, and 2) the method( dripping )
 by which the sample was drawn; 3) date of commencement of
 the delivery; 4) name of bunker barge of installation; 5) name
and IMO number of receiving vessel ; 6) signatures and names
of the supplier's and ship's representative; 7) details of seal ID
and the bunker grade supplied.
    5. Reg. 18(7) ( Registration of the suppliers and their responsibilities) :
         
          This regulation requires that parties to the protocol undertake to
 ensure that authorities regulate suppliers to their responsibilities
 for compliance. The regulation identifies the following
requirements.

              a. suppliers must register with the local authorities.
              b. suppliers must provide a BDN and a sample in accordance
with the  requirements of the regulations previously stated.
This sample must also state that the fuel is in compliance
to regulations 14 and 18 of Annex VI.
              c. supplier has to retain a copy of the BDN for a minimum of
                three years for verification by port state control.
              d. action will be taken against supplier if the fuel supplied
does not  comply  with that stated on the BDN by patries
to the protocol of 1997.
              e. the authority's designate must inform the administration of
 any ship receiving fuel oil not in compliance with
 regulations 14 & 18.
              f. if suppliers fail to meet the requirements specified in
 regulations 14 and 18 of Annex VI, they will be reported to
 IMO in order for that information to be passed on to all
 parties to the Protocol of 1997.
